Electricity, Gas and Fossil Fuels
The energy team of PM&P provides complete legal service to its clients in connection with the free energy market entry, the trade in electricity, investment projects and dispute resolution concerning the new electricity and gas transmission infrastructure, including some strategic national projects like certain aspects of the South Stream project. The work on these projects involves, of course, the preparation of opinions on the compliance with the Bulgarian and EU regulatory requirements.
The lawyers of the firm defend the interests of clients in some of the most complicated and unique cases of particular relevance to the community. This is the case, for instance, with the successful defense of Entertrag in its dispute with the National Electric Company concerning the validity of a preliminary contract for the connection of 500 MW, where the judgment has been confirmed by the Supreme Court of Cassation. In connection with the appeal against the unlawful decision on the fixing of temporary prices for access to the grid, the firm files claims for damages resulting from unlawful restrictions of power generation from renewable sources and reimbursement of access price payments and other investments made.
In the capacity of advisors to the Bulgarian Chamber of Commerce and Industry, the German Bulgarian Chamber of Industry and Commerce, the Bulgarian Wind Energy Association and the Bulgarian Photovoltaic Association, PM&P takes part in all stages of the legislative drafting process in the energy sector.
The striving of the firm for a modern approach to these matters is demonstrated also in the proposals for the establishment of an entirely new market model for liberalization and restructuring of relations in the electricity sector, which are the first of their kind.
Members of the PM&P team work also as experts on the preparation of the Third Energy Package at the European Parliament and teach subjects related to energy regulations and legislation at leading Bulgarian universities.
